The Jigawa High Court of Justice sitting in Kazaure Presided by Honourable Justice Hussaina Adamu Aliyu has discharged and acquitted one Halilu Haruna of Ture kwado Village from Gwiwa local government.

Haruna was arraigned before the court on the 19th October 2020, for the offence of Culpable homicide punishable with death under Sec. 221(b) of the Penal Code Law.

The offence was committed on the 13th November, 2019, at Jigawar Didinya village of Gwiwa Local Govt.

The facts of the case was that, the defendant was said to have used a stick and beats one Hauwa’u Adamu (deceased) which led to her death.

The defendant was arrested and charged to court, but he denied the charge.

In order to prove the case, the prosecution called two witnesses and tendered two exhibits and closed its case. While the defendant testified as a witness in his own defence and closed his case.

In delivering its judgment, the court held that none of the prosecution witnesses connect the defendant with offence of culpable homicide punishable with death, therefore the prosecution failed to prove its case beyond reasonable doubt, the court thereby discharged and acquitted the defendant.

In another judgment, the Jigawa High Court of Justice sitting in Hadejia, presided over by Hon. Justice Ado Yusuf delivered judgment on Tuesday 2nd December, 2021, against one Magaji Hussaini (alias Lushe) who was found guilty for the offence of Culpable Homicide punishable to death under section 221 (b) of the Penal Code Laws of Jigawa State, 2012.

The defendant who is from Rugar Lamido Dadi Fulani Settlement, Kirikasamma Local Government had used a stick to beat one Muhammad Alhaji (Deceased) on his neck and caused injury to the deceased which resulted in his death.

The Prosecution in prove of its case called 6 witnesses and tendered 3 exhibits which were Statements of the defendant at Kiri Kasamma Divisional Police Office, Statements of the Defendant at SCID Dutse and the photograph of the deceased.

The court admitted the Exhibits and marked them as Exhibit P1, P2 and P3 respectively while the defendant testified in his defence and denied the allegation.

The presiding judge, Honourable Justice Ado Yusuf ruled that he was satisfied that the evidence of the prosecution had proved the charge beyond reasonable doubt, therefore His Lordship sentenced the defendant to death by hanging for the offence of Culpable Homicide punishable with death under section section 221 (b) of the Penal Code Laws of Jigawa State, 2012.
